Network role and advertiser/publisher relationships
STP Media operates a performance marketing network that connects advertisers and publishers. Advertisers and publishers contract and interact with each other through the network on the basis of the offers, terms, and tracking arrangements they accept. Each advertiser and each publisher is an independent third party and is solely responsible for its own conduct, content, traffic, claims, payments, refunds, chargebacks, regulatory compliance, and contractual obligations.
We do our best to monitor activity on the network on a continuous basis — including campaign quality, traffic quality, creative compliance and known fraud signals — and we may suspend or remove advertisers or publishers who breach their obligations. Despite these efforts, monitoring is provided on a reasonable-endeavours basis only and we do not guarantee the conduct, performance, solvency, accuracy of representations, or compliance of any advertiser or publisher.
To the maximum extent permitted by law, STP Media Ltd is not responsible or liable for any losses, damages, costs, claims, or disputes arising between advertisers and publishers, including but not limited to: disputes over conversions, payouts, scrubs, chargebacks, refunds, attribution, traffic quality, lead quality, alleged fraud, intellectual property, or breach of any contract or policy between an advertiser and a publisher. Resolution of any such matter is the responsibility of the advertiser and publisher concerned. We may, at our discretion, assist with informal mediation, but doing so does not create any liability or duty on our part.
Nothing in this section is intended to limit liability that cannot be limited under applicable law (including for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence).
